1. Who you are contracting with

These terms are a binding agreement between you and DWERKS HOSTING (“DWERKS HOSTING”, “we”, “us”), the provider of the shared hosting, reseller hosting, domain registration and related services offered on this website (the “Services”).

2. Acceptance

By creating an account, purchasing a plan or continuing to use the Services you agree to these terms. If you are entering into them for an organisation, you confirm you have the authority to bind that organisation. If you are contracting as an individual, you confirm you are of legal age in your country.

3. Your account

You must provide accurate registration and contact information and keep it up to date. You are responsible for keeping your credentials confidential and for all activity that takes place under your account.

4. Acceptable use

You must not use the Services to:

  • break any applicable law or regulation;
  • send spam, run phishing campaigns or commit fraud;
  • host or distribute content that infringes another party’s intellectual property;
  • distribute malware, attempt to gain unauthorised access, probe or scan our systems, or interfere with the security or performance of the platform or other customers;
  • resell or redistribute the Services outside the terms of a reseller plan;
  • reverse engineer the platform or circumvent plan resource limits.

5. Licence and intellectual property

We grant you a limited, non-exclusive, non-transferable right to use the Services within the plan you have selected. We retain ownership of the platform, software, documentation and branding. You retain ownership of your website content, and grant us the limited licence needed to host, transmit and back up that content in order to provide the Services.

6. Service levels

We work hard to keep the platform available, but we do not guarantee that the Services will be uninterrupted, error-free or free from loss of data. Maintenance, third-party network failures and events outside our reasonable control may affect availability.

7. Payments, billing and cancellation

Plans are billed in advance on a monthly or annual cycle, as shown at checkout, and renew automatically until cancelled. Payment, billing, tax, invoicing, cancellation and refund mechanics are handled by our payment provider under Paddle’s Buyer Terms. Our own refund commitments are set out in our Refund Policy.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

8. Suspension and termination

We may suspend or terminate access where there is a material breach of these terms, non-payment, a security or fraud risk, or repeated or serious policy violations. Where practical we will notify you first and give you an opportunity to resolve the issue. You may cancel at any time; access continues until the end of the paid period. After termination you will normally have 30 days to export your data before it is deleted.

9. Warranties and liability

To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We are not liable for indirect or consequential loss, including loss of profits, data or goodwill. Our aggregate liability is limited to the fees you paid in the 12 months before the claim. Nothing in these terms excludes liability for fraud, death or personal injury where the law does not allow it.

You agree to indemnify us against claims arising from your content, your unlawful use of the Services or your breach of these terms.

10. General

You may not assign this agreement without our consent; we may assign it as part of a merger or acquisition. Neither party is liable for delays caused by events beyond their reasonable control. These terms are governed by the laws of the jurisdiction in which DWERKS HOSTING is established, and disputes will be heard by the courts of that jurisdiction. We may update these terms and will post the revised version on this page.
